What happens if I separate from my partner?
There Is no law In England and Wales regulating the separation of unmarried couples. There are laws that govern the ownership of property and protection of children.
It is a good idea to resolve disputes by agreement, this is often a cheaper and a less distressing process than court.
Would we have to involve the court?
If agreement is not possible you can ask the court to decide what share of the house you own and whether it should be sold so that you can realise that share. To do this you need to make a claim under the Trust of Land and Appointment of Trustees Act 1996 (ToLATA).
What about child maintenance?
In most cases, the Child Maintenance Service deals with child maintenance claims.
You can apply to the court for Income for the children under Schedule 1 of the Children Act 1989. We can advise you on this.
What is a Separation Deed?
If you can reach an agreement you may wish to enter a Separation Deed. This Is a legally binding document that formalises the terms of your separation.
